Terms of Service

Section 1

Agreement to Terms

By accessing or using any service provided by AQTHEVISION ("we," "us," or "our") through aqthevision.ai, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

These terms apply to all users, including business owners, authorized team members, and anyone who accesses the platform on behalf of a subscribing organization.

Section 2

Service Description

AQTHEVISION provides autonomous AI agent teams designed to handle day-to-day business operations, including but not limited to customer communication, scheduling, content creation, reputation management, and lead capture.

Our AI agents are tools that assist with business operations. They are not a replacement for human judgment. You remain fully responsible for all business decisions, legal compliance, and outcomes that result from using our services. AI-generated outputs should be reviewed by a qualified person before being relied upon for critical decisions.

Section 3

Subscription and Billing

AQTHEVISION operates on a monthly recurring subscription model. The following packages are available:

Subscriptions are billed monthly on the anniversary of your start date.
You may cancel at any time. Cancellation takes effect at the end of your current billing period.
No refunds are issued for partial months of service.
We reserve the right to adjust pricing with 30 days' written notice.

Section 4

Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your account credentials.
All activity that occurs under your account.
Providing accurate and up-to-date business information.
Notifying us immediately of any unauthorized access to your account.

You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of your business.

Section 5

Acceptable Use

You agree not to use AQTHEVISION services to:

Engage in any illegal, fraudulent, or deceptive activity.
Send unsolicited communications (spam) through our AI agents.
Abuse, overload, or attempt to exploit the AI agents beyond their intended purpose.
Distribute malware, harmful code, or interfere with the platform's infrastructure.
Impersonate another person or entity.
Violate the rights of any third party, including intellectual property and privacy rights.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Section 6

Intellectual Property

Your data: You retain full ownership of all business data, content, and materials you provide to the platform. We do not claim ownership of your data.

Our platform: AQTHEVISION retains all rights to the platform, including its software, AI models, agent architectures, interfaces, branding, and documentation. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for the duration of your subscription.

Outputs generated by our AI agents using your data belong to you. The underlying technology and methods used to produce those outputs remain the property of AQTHEVISION.

Section 7

Data Processing

To provide our services, our AI agents process your business data, which may include customer contact information, appointment records, communications, and other operational data you provide or that is generated through platform use.

We process data solely to deliver and improve the services you have subscribed to.
We do not sell your data to third parties.
Data may be processed by third-party AI providers (such as language model APIs) as necessary to operate the agents. These providers are bound by their own data processing agreements.

Section 8

Limitation of Liability

To the maximum extent permitted by applicable law:

AQTHEVISION is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
We do not guarantee uninterrupted or error-free operation of our AI agents.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Our total liability for any claim related to the service shall not exceed the amount you paid us in the three (3) months preceding the claim.

You acknowledge that AI systems can produce inaccurate or unexpected outputs, and you agree to review all AI-generated content before relying on it for business decisions.

Section 9

Termination

Either party may terminate this agreement at any time:

You may cancel your subscription through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period.
We may terminate or suspend your account if you violate these terms, fail to pay, or engage in conduct that harms other users or our infrastructure.

Upon termination, you will have 30 days to export your data. After 30 days, we may permanently delete your account data. We will provide reasonable assistance with data export upon request.

Section 10

Governing Law

These terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from or relating to these terms or your use of the services shall be subject to the exclusive jurisdiction of the courts of Montreal, Quebec, Canada.

Section 11

Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or through the platform at least 15 days before the changes take effect.

Your continued use of the services after the updated terms take effect constitutes your acceptance of the changes. If you do not agree with the revised terms, you may cancel your subscription before the changes take effect.
